Kizmio – Terms of Use

Welcome to Kizmio. These Terms of Use ("Terms") govern your access to and use of the Kizmio platform, website, mobile applications, and related services (collectively, the "Platform"). By creating an account or using Kizmio, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Acceptance of Terms

By accessing or using Kizmio, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, Community Guidelines, and any additional policies or guidelines that may be published from time to time.

2. User Responsibilities

3. Original Content

Kizmio encourages members to publish original and authentic content.

By submitting content to the Platform, you represent and warrant that:

• You created the content, or you have all necessary rights, permissions, or licenses to publish it.

• Your content does not infringe any copyright, trademark, patent, privacy, publicity, or other intellectual property rights.

• Your content does not violate the rights of any individual or organization.

• The information you provide is accurate and not misleading.

Repeated posting of copied, unauthorized, or infringing material may result in content removal, loss of platform privileges, suspension, or permanent account termination.

4. Prohibited Content

You may not post, upload, distribute, or promote content that includes or encourages:

• Adult or pornographic material

• Sexually explicit or sexually suggestive content

• Nudity intended for sexual gratification

• Child sexual abuse or exploitation

• Prostitution or sexual services

• Graphic violence or extreme gore

• Hate speech or discrimination

• Harassment, bullying, intimidation, or threats

• Terrorism or extremist propaganda

• Illegal activities or criminal instructions

• Fraud, scams, phishing, impersonation, or deceptive practices

• Malware, viruses, or malicious software

• Content encouraging self-harm or suicide

• Any content that violates applicable laws or regulations

Kizmio reserves the right to remove any content that violates these Terms or is otherwise considered harmful to the Platform or its community.

5. Intellectual Property

You retain ownership of the content you create and publish.

By posting content on Kizmio, you grant Kizmio a non-exclusive, worldwide, royalty-free, transferable license to host, store, display, reproduce, distribute, modify (only as necessary for technical purposes), and promote your content solely for operating, improving, securing, and promoting the Platform.

You may remove your content at any time, subject to backups, legal obligations, or content already shared by others as permitted by the Platform.

If you believe your copyrighted work has been infringed, please contact Kizmio through our official copyright reporting process.

6. Content Moderation

To maintain a safe and trusted community, Kizmio may review, restrict, remove, or disable access to content that violates these Terms, Community Guidelines, or applicable law.

We may also issue warnings, temporarily suspend, permanently terminate, or otherwise limit accounts that repeatedly violate our policies.

7. Monetization

Certain features may allow eligible users to earn income through the Platform.

Participation in monetization programs is subject to separate eligibility requirements and platform policies.

Kizmio may suspend, adjust, withhold, or revoke monetization privileges or earnings if fraudulent activity, policy violations, abuse, or other misconduct is detected.

Participation in monetization programs does not guarantee future eligibility or payment.

8. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You agree to notify Kizmio immediately if you suspect unauthorized access to your account or any security breach.

You are responsible for all activities that occur under your account unless caused by our negligence.

9. Disclaimer of Warranties

Kizmio is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

We do not guarantee uninterrupted service, error-free operation, or that all content on the Platform will be accurate, complete, or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, Kizmio, its owners, employees, affiliates, partners, and service providers shall not be liable for:

• User-generated content

• Errors or inaccuracies in user content

• Loss of data, profits, or business opportunities

• Service interruptions

• Disputes between users

• Copyright or intellectual property disputes arising from user submissions

• Any indirect, incidental, special, or consequential damages arising from use of the Platform

Users remain solely responsible for their own actions and content.

11. Indemnification

You agree to defend, indemnify, and hold harmless Kizmio, its owners, affiliates, employees, administrators, partners, and service providers from any claims, liabilities, damages, losses, expenses, or legal costs arising from:

• Your use of the Platform

• Your content

• Your violation of these Terms

• Your violation of applicable laws

• Your infringement of any third-party rights

12. Account Suspension or Termination

Kizmio may suspend, restrict, or permanently terminate accounts that:

• Violate these Terms or Community Guidelines

• Publish prohibited or illegal content

• Engage in fraud or abusive behavior

• Infringe intellectual property rights

• Attempt to manipulate monetization or platform systems

• Compromise the safety, integrity, or security of the Platform or its users

Enforcement decisions are made at Kizmio's reasonable discretion.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices.

The updated version becomes effective when published. Your continued use of Kizmio after any updates constitutes acceptance of the revised Terms.
